These Terms of Use (“Terms”) are an agreement between you and Sina Alparslan (“Developer”, “we”, “us”, “our”) for your use of the eReader app for iPhone, iPad and Mac (the “App”) and this website (the “Site”). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
If you are under the age of legal majority where you live, you may use the App only with the consent of a parent or guardian who agrees to these Terms on your behalf.
1. Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install and use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed, not sold.
You may not:
- Copy, modify, adapt, translate or distribute the App or any part of it, except as these Terms or the law expressly allow.
- Reverse engineer, decompile or disassemble the App, except to the extent this restriction is prohibited by applicable law.
- Rent, lease, lend, sell, sublicense or otherwise transfer the App.
- Remove, alter or obscure any copyright, trademark or other proprietary notice.
- Circumvent or interfere with security, purchase, advertising or usage-limit mechanisms in the App.
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
2. Intellectual property
The App, including its code, design, text, graphics and trademarks, is owned by Sina Alparslan or its licensors and is protected by intellectual-property laws. These Terms give you no rights in our names, logos or other brand elements. Open-source components included in the App are licensed under their own terms. Apple, iPhone, iPad, Mac, iCloud and App Store are trademarks of Apple Inc.; the App is not endorsed by Apple.
3. Your books and content
The App is a tool for reading files that you provide. We do not supply, host, review or have access to your books.
- You keep all rights in the files you add and in the highlights and notes you create.
- You are solely responsible for making sure you have the legal right to possess, open, copy, convert to speech, summarise and share the files you use with the App, and for complying with copyright and other laws that apply to them.
- The App does not remove or bypass digital rights management (DRM), and you must not use it together with any tool that does so unlawfully.
- Sharing a quote, a summary or a book file is your decision and your responsibility. Do not share material you do not have the right to share.
- You are responsible for keeping your own copies of your files. Deleting a book or the App deletes its reading data, and we cannot recover it.
You agree not to use the App to violate any law, infringe the rights of others, or engage in any activity that could harm others, the App or its providers.
4. Premium subscriptions and purchases
The App is free to download. Some features require a paid “Premium” subscription. Features included in the free and Premium versions may change over time.
- Billing. Purchases are processed by Apple through your Apple Account and are subject to Apple's terms. The price, currency and billing period are shown in the App before you confirm.
- Automatic renewal. A subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You can manage or cancel a subscription at any time in Settings › [your name] › Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you have paid for. Deleting the App does not cancel a subscription.
- Free trials and offers. If a free trial or introductory offer is provided, any unused part of it is forfeited when you purchase a subscription, where applicable.
- Refunds. Payments are handled by Apple and refunds are decided by Apple under its policies; request one at reportaproblem.apple.com. Nothing in these Terms limits any statutory right to withdraw or to a refund that you have as a consumer under the law of your country.
- Price changes. We may change subscription prices. Apple will notify you in advance and, where required, ask for your agreement before a new price applies to you.
- Restoring purchases. Use “Restore Purchases” in the App to restore an active subscription on another device signed in with the same Apple Account.
5. Advertising
The free version of the App displays advertisements supplied by third parties. We do not control and are not responsible for the content of those ads or for the products, services or websites they promote. Any dealings you have with an advertiser are between you and that advertiser. Optional rewarded ads grant a temporary benefit in the App, which has no cash value and may be changed or withdrawn.
6. Read-aloud, AI summaries, reading aids and statistics
- Read-aloud uses the text-to-speech voices on your device. Pronunciation, language detection and pacing may be imperfect. Do not use the App in a way that distracts you while driving, cycling, operating machinery or in any situation that needs your full attention.
- AI summaries are generated automatically on your device by Apple Intelligence. They may be inaccurate, incomplete or misleading, and they may omit or misstate what a text says. They are provided for convenience only and must not be relied on for study, professional, legal, medical, financial or safety decisions. Availability depends on your device, system settings, language and region, and may change.
- Reading aids (such as Bold Word Starts, Paragraph Focus and Color Flow) and reading templates are optional display options. They are not medical devices, treatments or accessibility guarantees, and we make no claim that they improve reading speed, comprehension or any condition.
- Statistics and estimates (reading time, speed, time remaining, streaks) are approximations.
- File compatibility. We do not guarantee that every EPUB or PDF file will open or display correctly. Files with DRM, unusual structure, scanned pages or complex layouts may not work or may lose formatting.
- Sync. iCloud sync depends on Apple's services and your iCloud settings and storage. It is not a backup service, and we do not guarantee that data will be synchronised or preserved.
7. Third-party services
The App relies on services provided by third parties, including Apple (App Store, iCloud, Apple Intelligence, system voices) and Google (Firebase, AdMob). Those services are governed by their own terms and privacy policies. We are not responsible for their availability, content or practices, and a change or interruption in a third-party service may affect features of the App.
8. Privacy
Our Privacy Policy explains how data is handled when you use the App and forms part of these Terms.
9. Updates and changes to the App
We may update, change, suspend or discontinue the App or any feature at any time, including to comply with law or platform requirements. Updates may be required to keep using the App. We have no obligation to provide any particular feature, update or support, except as required by law. If you have paid for a subscription period and we permanently discontinue the App during it, any refund is subject to Apple's policies and to your statutory rights.
10. Disclaimer of warranties
To the maximum extent permitted by applicable law, the App and the Site are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure or free of harmful components, that defects will be corrected, that your files or data will not be lost, or that the App will meet your requirements. You use the App at your own risk.
11. Limitation of liability
To the maximum extent permitted by applicable law, Sina Alparslan shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, files, use, goodwill or other intangible losses, arising out of or relating to:
- Your use of, or inability to use, the App or the Site.
- Any loss of or damage to your files, highlights, notes or other data.
- Any unauthorised access to or use of your data or device.
- Any bugs, viruses, errors or inaccuracies in the App, including in AI summaries and read-aloud output.
- Any content, conduct, product or service of a third party, including advertisers and service providers.
To the maximum extent permitted by applicable law, our total liability for all claims relating to the App or these Terms is limited to the greater of (a) the amount you paid for the App or its subscriptions in the twelve months before the event giving rise to the claim, and (b) fifty U.S. dollars (US$50).
These limitations apply whether the claim is based on contract, tort (including negligence), strict liability or any other legal theory, and even if we have been advised of the possibility of such damages.
12. Your statutory rights are not affected
Some countries, states and provinces do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for intent or gross negligence where the law so provides. If you are a consumer, you keep the benefit of the mandatory consumer-protection laws of your country of residence (for example the Australian Consumer Law, or consumer law in the European Union and the United Kingdom), and nothing in these Terms takes those rights away.
13. Indemnification
To the extent permitted by law, you agree to indemnify, defend and hold harmless Sina Alparslan from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, the files or content you use or share with it, your violation of these Terms, or your violation of any law or the rights of a third party. This section does not apply to consumers where such an obligation is not permitted by the law of their country.
14. Termination
These Terms apply until terminated by you or us. You may end them at any time by deleting the App (and cancelling any subscription through Apple). We may suspend or terminate your licence at any time, without prior notice, if we reasonably believe you have breached these Terms or that your use is harmful to other users, to us or to third parties, or where required by law.
On termination your right to use the App ends immediately. Sections that by their nature should survive termination (including intellectual property, your content, disclaimers, limitation of liability, indemnification and governing law) will survive.
15. Legal compliance and export
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all export-control and sanctions laws that apply to your use of the App.
16. Apple-specific terms
The App is distributed through Apple's App Store, and the following terms apply to you:
- Acknowledgement. These Terms are between you and Sina Alparslan only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Maintenance and support. Apple has no obligation to provide any maintenance or support services for the App.
- Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy or similar legislation.
- Intellectual-property claims. If a third party claims that the App or your possession and use of it infringes its intellectual-property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your mobile data agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Your use of the App is also subject to Apple's Licensed Application End User License Agreement (Standard EULA). If these Terms conflict with Apple's Standard EULA or the Apple Media Services Terms and Conditions on a matter Apple requires, Apple's terms prevail.
17. Governing law and disputes
These Terms are governed by the laws of the country in which the Developer is established, without regard to its conflict-of-law rules, and the courts of that country have jurisdiction over disputes arising from these Terms. This does not deprive you of the protection of the mandatory laws of the country where you live, or of your right as a consumer to bring proceedings in the courts of that country, where the law gives you those rights.
Before starting formal proceedings, please contact us through the Support page so we can try to resolve the matter informally.
18. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App and replace any earlier understanding.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a transfer of the App.
- Events beyond our control. We are not responsible for any failure or delay caused by events outside our reasonable control.
- Language. These Terms are written in English. If a translation differs from the English text, the English text prevails to the extent the law allows.
19. Changes to these Terms
We may modify these Terms from time to time. Changes take effect when posted on this page, and the date at the top shows the latest version. If a change is significant, we will give notice in the App or on this Site. Your continued use of the App after a change takes effect constitutes acceptance of the modified Terms. If you do not agree, stop using the App and cancel any subscription.
